ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I, the undersigned participant, acknowledge and agree to the following:

1. NATURE OF ACTIVITIES
I understand that Hear Him Encounters retreat activities may include, but are not limited to: group discussions, prayer sessions, worship services, outdoor activities, hiking, recreational activities, meals, lodging in shared accommodations, and travel to various locations. These activities involve inherent risks.

2. ASSUMPTION OF RISK
I voluntarily assume all risks associated with participation in this retreat, including but not limited to:
• Physical injury from recreational or outdoor activities
• Emotional or psychological distress
• Property damage or loss
• Illness or injury from food, accommodations, or environmental factors
• Transportation-related incidents
• Accidents or injuries caused by other participants, staff, or third parties
• Weather-related hazards
• Facility-related risks (slips, falls, equipment malfunction)

3. PHYSICAL AND MENTAL HEALTH
I represent that I am physically and mentally capable of participating in retreat activities. I will immediately notify retreat staff of any medical conditions, medications, allergies, or limitations that may affect my participation or require special attention.

RELEASE AND WAIVER OF LIABILITY

4. RELEASE OF CLAIMS
I hereby release, waive, discharge, and covenant not to sue Hear Him Encounters, its directors, officers, employees, volunteers, agents, affiliated organisations, property owners, and all other persons or entities acting on their behalf (collectively “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in the retreat or while on the premises owned or leased by any Released Party.

5. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any loss or liability incurred as a result of my actions or participation in retreat activities, including attorney fees and costs.

ADDITIONAL PROVISIONS

6. MEDIA RELEASE
I consent to the use of my name, voice, and likeness in photographs, videos, or other media for promotional or educational purposes by Hear Him Encounters without compensation.

7. PERSONAL PROPERTY
I acknowledge that Hear Him Encounters is not responsible for loss, theft, or damage to personal property during the retreat.

8. BEHAVIOR AND CONDUCT
I agree to conduct myself in a respectful manner consistent with the spiritual and community nature of the retreat. I understand that disruptive behavior may result in dismissal from the retreat without refund.

9. REFUND POLICY
I understand and accept the retreat’s cancellation and refund policy.

10. MEDICAL EMERGENCY
I authorise retreat staff to seek emergency medical treatment on my behalf if I am unable to make such decisions for myself, and I assume responsibility for any associated costs.

LEGAL PROVISIONS

11. SEVERABILITY
If any portion of this waiver is deemed invalid, the remaining provisions shall continue in full force and effect.

12. GOVERNING LAW
This agreement shall be governed by the laws of South Africa, and any disputes shall be resolved in the courts of Western Cape, South Africa.

13. ENTIRE AGREEMENT
This waiver constitutes the entire agreement between the parties and supersedes any prior understandings or agreements.

ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ AND FULLY UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY.
I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY.
